Il s'ajoute aussi la complication juridique que si certains pays - comme la France depuis un arrêt de la Cour de cassation de 2008 - autorisent l'inscription sur le livret de famille du fœtus né mort (ce qui me semble être le cas du fœtus dans le cas de l'AMG), d'autres pays, comme la Suisse, maintiennent la distinction entre le fœtus né mort et l'enfant viable mort-né (critère des 22 semaines et des 500 grammes adopté par l'OMS en 1977) et n'autorisent l'enregistrement à l'état-civil que pour l'enfant viable mort-né. Toutefois, à ma connaissance, les cantons francophones (à tout le moins Genève, Vaud et le Jura) délivrent des permis d'inhumer pour des petits êtres qui n'ont pas existé aux yeux de la législation fédérale, et le Conseil fédéral a annoncé un changement de législation (à cet égard, cf. l'interpellation parlementaire de la conseillère nationale Rosmari Quadranti du 11 décembre 2012 https://www.parlament.ch/fr/ratsbetrieb ... d=20124090 , la réponse du Conseil fédéral du 22 mars 2013, annonçant qu'il ne ferait rien, et le rapport du Conseil fédéral du 3 mars 2017 https://www.parlament.ch/centers/eparl/ ... BR%20F.pdf annonçant un virage à 180 degrés et proposant que les enfants nés sans vie soient enregistrés à l'état civil comme les enfants morts nés.
En fait, en Suisse, les cantons les plus favorables aux familles sont Genève, Vaud et avant tout Zurich, comme par hasard des cantons de tradition protestante qui n'ont jamais été confrontés à la problématique d'un clergé maintenant son contrôle des consciences par la peur des limbes - ou même de l'enfer, puisque le concile de Florence de 1439 prévoyait l'enfer pour les enfants morts sans baptême. (Avant la sécularisation de l'état-civil en 1874, les cantons catholiques refusaient d'enregistrer les morts-nés.)

Après 150 ans de sécularisation, les différences restent marquées, et les cantons de tradition protestante sont plus à l'écoute des parents de fœtus nés morts. Comme l'état-civil est une compétence fédérale et que la Confédération n'accorde aucune existence aux enfants morts avant la 22e semaine de gestation, Genève, Vaud et Zurich contournent en partie l'obstacle du fait que les cimetières sont compétence cantonale. Ils délivrent donc, à la demande des parents, des permis d'inhumer pour des fœtus nés morts, mais ils ne peuvent pas mentionner de lien de filiation, puisque l'état-civil est compétence fédérale et empêche l'inscription des enfants morts avant la 22e semaine de gestation. Dans le canton de Genève, les permis d'inhumer pour les enfants morts avant la 22e semaine de gestation - et donc non-existants aux yeux de la Confédération - indiquent uniquement le prénom ("l'enfant Untel"). Dans les cimetières du canton, on reconnaît les tombes des enfants morts avant la 22e semaine de gestation à ce que la croix funéraire ne mentionne qu'un prénom et l'année de la fausse couche ou de l'avortement, tandis que les croix funéraires des enfants morts à partir de la 22e semaine de gestation mentionnent le nom de famille en plus du prénom, et le jour en plus de l'année.

Juste une parenthèse :

Cette prière apporte certainement un soulagement aux femmes qui se repentent d’avoir avorté volontairement, le problème est que dans beaucoup d’euchologes, c’est la même prière qui est proposée pour le cas des fausses couches, et pour une femme déjà affectée par la perte involontaire de son enfant, se voir qualifiée de pécheresse et de meurtrière (curieux ce concept de meurtre involontaire), c’est plutôt un traumatisme.

Dans son manuel de confession, Saint Nicodème de la Sainte Montagne, se basant sur un canon (n°22) de Saint Jean le jeuneur (VIème siècle), prévoit une privation de communion d’un an pour les femmes ayant fait une fausse couche. Savez-vous si il y a encore beaucoup de confesseurs qui appliquent cette règle ?

Pour résumer de la manière la plus simple et brutale une question complexe, l'Eglise orthodoxe n'est pas entrée dans les ratiocinations des catholiques romains, des juifs et des musulmans sur le moment de l'animation du fœtus. L'embryon a une âme immortelle dès le moment de la conception et l'avortement est un meurtre dès ce moment.
Partant de cette position de principe très stricte, l'Eglise orthodoxe n'a pas adopté, sur le plan pastoral, une position aussi rigide que celle sur laquelle l'ECAR campe depuis le XIXe siècle. Sans vouloir banaliser un acte qui reste un homicide et qui entraîne aussi une grande souffrance morale chez le père et chez la mère - un acte dont, au demeurant, les communistes qui opprimèrent la plus grande partie des orthodoxes au XX e siècle, faisaient une active promotion qui aurait réjoui M. Mélanchon -, l'Eglise orthodoxe tient aussi compte des motivations et du repentir de chacun. En pratique, les peines canoniques sont tombées en désuétude depuis mille ans.
Je pense aussi que la relative mansuétude de l'Eglise orthodoxe envers les parents qui ont choisi - ou dû choisir - d'avorter découle aussi d'un plus grand optimisme quant au sort des enfants morts dans le ventre de leur mère, ce qui n'étonne pas de la part d'une Eglise qui n'a pas adopté l'augustinisme et qui n'a pas consacré des théories aberrantes comme les limbes ou la prédestination. Le sort des embryons et des fœtus morts, ainsi que les différentes opinions des Pères sur le corps qui sera le leur au moment de la résurrection, est remarquablement abordé par Jean-Claude Larchet dans le chapitre qu'il consacre au statut de l'embryon.

Les ratiocinations des catholiques romains sur le moment de l'animation du fœtus ne sont pas restées sans conséquences pratiques. Dans un livre que je n'aime pas - qui en tout cas, en terme d'esprit orthodoxe et de patristique, ne soutient pas un seul instant la comparaison avec l'ouvrage de Larchet sur l'éthique de la procréation, le médecin et philosophe étasunien H. Tristram Engelhardt rappelle que, de 1234 à 1869, l'Eglise catholique romaine n'a pas considéré l'avortement précoce (c'est-à-dire celui du fœtus supposé ne pas encore avoir reçu l'âme) comme un homicide:

From 1234 until 1869, the Roman Catholic canons did not hold early abortion to be equivalent to murder. John T. Noonan, Jr., "An Almost Absolute Value in History" in John T. Autrement dit, le "Magistère" infaillible et qui n'aurait jamais changé d'avis sur rien avant l'affreux concile de Vatican II inlassablement dénoncé par les lefebvristes, survivantistes, sédévacantistes, palmaristes et autres, a tout de même changé d'avis sur le sujet en 1588, 1591 et 1869.

Du point de vue orthodoxe, pas de discussions sur le moment de l'animation et autres: un avortement est un homicide à n'importe quel moment de la grossesse. Autres sont ensuite les circonstances, les motivations et les causes, qui justifient une pratique pastorale et spirituelle différenciée.
